Data Management Policy

(1) This policy applies to customers on a Talk, Text and Data Plan. This policy should be read in conjunction with the chatr Terms of Service and the Acceptable Use Policy. All defined terms that are not defined here shall have the same meaning as in the chatr Terms of Services.

(2) If your data usage in a month exceeds your 4G speed data allotment, you can continue to use data with no overage charge, but managed data speeds will be reduced from up to 150 Mbps to up to 128 kilobits per second (for both download and upload) until your Anniversary Date. Even applications that do not require high bandwidth (such as email and web browsing) will be affected by this speed reduction. Applications that will likely be significantly affected by this speed reduction are those that demand higher bandwidths (for example video streaming).

(3) If your data usage in a month exceeds your 3G speed data allotment, you can continue to use data with no overage charge, but managed data speeds will be reduced from up to 10 Mbps to up to 64 kilobits per second (for both download and upload) until your Anniversary Date. Even applications that do not require high bandwidth (such as email and web browsing) will be affected by this speed reduction. Applications that will likely be significantly affected by this speed reduction are those that demand higher bandwidths (for example video streaming).

(4) Many handsets have the ability to keep track of your monthly data usage. To further assist you in managing your data usage, we will send you text messages when you are close to reaching your monthly 4G or 3G speed data allotment at no additional charge.

(5) Chatr may also enhance performance of its mobile wireless network by optimizing video streaming. Optimizing video streams may result in faster load times and fewer or no playback interruptions or stalls during common mobile usage. Due to the small screen size of a smartphone or tablet, the impact on image quality should be minimal or unnoticeable. Video optimization can also lower mobile customers’ data usage and create less network congestion. Optimization may occur with all detected video streamed over the chatr network in Canada (including Extended Coverage), as well as foreign networks. Optimization does not apply to streaming over WiFi, video messages or conferencing, nor to videos saved to your device.

(6) Our wireless network is designed and built to provide consistent high-speed data service, but at times and in areas where the number of customers using the network exceeds available network resources, customers will experience reduced data speeds. To provide the best possible experience for the most customers, we implement dynamic congestion internet traffic management practices; customers with significant, heavy-data usage creating an unusually large burden on the network may be subject to lower network prioritization. Rogers First Priority Service also provides priority access to first responders, public safety officials, and critical infrastructure personnel, and data connections from these users are always prioritized by the mobile network during congestion.

As a result, chatr customers connecting to sites in congested areas may experience slightly slower speeds and delayed response times when using data services, such as browsing and uploading or watching videos. In extremely rare cases, data connections could need to be re-initiated. 9-1-1 service is never impacted. Prioritization should be unnoticeable except during times and in areas of congestion, is applied on a content-agnostic basis (all applications treated equally), and is relative; during periods of heavy congestion, all users will experience slower speeds.

In-zone Data Management Policy

Formerly known as the Fair Use Policy.

(1) This policy applies to customers with our in-zone data services. This policy should be read in conjunction with the chatr Terms of Service and the chatr Acceptable Use Policy. All defined terms that are not defined here shall have the same meaning as in the chatr Terms of Services.

(2) Our in-zone data services must originate and be used within the chatr data zones.

(3) If your in-zone data usage in a month exceeds your 3G speed data allotment, you can continue to use data with no overage charge, but managed data speeds will be reduced from up to 10 Mbps to up to 64 kilobits per second (for both download and upload) until your Anniversary Date. Even applications that do not require high bandwidth (such as email and web browsing) will be affected by this speed reduction. Applications that will likely be significantly affected by this speed reduction are those that demand higher bandwidths (for example video streaming).
